社會就公民提名一事爭論了好一段時間,民調顯示有六成市民支持公民提名,但建制派人士則認為此舉違反基本法的規定。我個人認為公民提名符合基本法對政制發展的目標,那就是實行普選。而且,公民提名亦符合香港的實際情況,因為香港的區議會和立法會都是以公民提名作為參選的規定。可以見到公民提名並非甚麽洪水猛獸。至於公民提名如何與基本法配合的問題,有些人認為提名委員會無權否決公民提名的候選人;但有些人認為提委會應設立低門檻確認公民推薦的準候選人。但無論如何,現在都被攻擊為削弱和架空提名委員會的權力,這樣的做法沒有體現機構提名或集體意志。但我認為既然政制發展的目標是普選,我們是否更應關心提名委員會會否反過來削弱公民的政治權利呢?

 

最近有些人問我: 為甚麼佔中運動不高調支持公民提名這個方案? 我要借助這個機會解釋一下。佔中爭取的是一個符合國際標準的普選方案,所謂符合國際標準的普選方案不單是一人一票,在提名和參選過程亦要公平、公開,要給市民真正的選擇。公民提名當然符合這個精神。但能夠符合國際標準的,仍有其他提名方式。我們認為在商討階段應百花齊放,所以不會特別高調支持某一個提名方案。但到了6月22日全民投票選出一個佔中的政改方案之後,無論是只有公民提名的方案,或者是多軌方案,又或者是提委會低門檻提名方案,只要它們沒有設置不合理參選限制及讓市民有真正的選擇,我們都會高調支持。

Why does OCLP not give a high-profile support to the civil nomination proposal?

 

Civil nomination has been a subject of debate for quite some time.  Opinion polls showed that 60% of the people in Hong Kong support civil nomination while the pro-establishment camp argues that it is in violation of the Basic Law.  Personally I believe that civil nomination is in line with the Basic Law with regard to the goal of constitutional development, i.e., universal suffrage.  Civil nomination is also in line with the actual situation in Hong Kong, where it has already been practiced in the District Council and Legislative Council elections.  As such, civil nomination should not be seen as something like a scourge.  As to the question of how civil nomination conforms to the Basic Law, some believe the nomination committee does not have the right to reject candidates produced by civil nomination while some believe that the nomination committee should acknowledge such candidates upon a low threshold.  In either case, civil nomination is accused of weakening the power of the nomination committee and failing to embody its collective will.  However, I think if the goal of constitutional development is to achieve universal suffrage, should we be actually more concerned that the nomination committee will weaken the political rights of the citizens?

 

Recently some people asked me: why does OCLP not give a high-profile support to the civil nomination proposal?  Let me take this opportunity to explain.  Occupy Central strives for a universal suffrage proposal that meets international standards, which include not just one-person-one-vote but also a fair and open process of nomination and participation in elections that would give people a genuine choice.  Civil nomination agrees with such a spirit of course but there are also other proposals that meet international standards.  At this stage of deliberations, we should encourage free expression of different ideas rather than showing a clear support to any particular proposal.  When the final OCLP proposal comes out from the civil referendum on Jun 22, we will give our high-profile support regardless of whether it is civil nomination, multi-track, or nomination committee with a low threshold.  The key is that it cannot set any unreasonable restrictions and will provide people with a genuine choice.
